Most people, at some time in their lives, receive a traffic ticket. Some people believe that hiring an attorney for a traffic ticket or DWI charge is not necessary. However, there are a few things that should be considered before making that decision. First, many motor vehicle violations impose a penalty of incarceration. The threat of being sentenced to a jail term should be taken seriously and a lawyer should be hired to determine the maximum penalty for your offense and to protect your freedom. Second, some motor vehicle violations (especially DWI charges) also carry with it a threat of suspension of your drivers’ license. Remember, driving is a privilege and not a right under the law. Thus, the State may take away that privilege without the same due process afforded to our constitutional rights.

In addition, pleading guilty to a violation usually carries with it the assessment of “points” that are considered by your insurance carrier in setting your insurance rates. Insurance companies interpret the “points” as a negative indicator of your driving habits. More “points” equal a risky driver, which in turn means higher insurance premiums.
